1. Acceptance of Terms

By accessing or using PlayThis.Live ("Service," "Platform," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

PlayThis.Live is a web platform that enables DJs and event organizers to:

• Create and manage live music events
• Collect and manage song requests from event attendees
• Provide real-time interaction between DJs and their audience
• Access analytics and performance insights
• Manage subscription-based access to premium features

3. User Accounts and Registration

3.1 Account Creation

• You must create an account to access certain features of the Service
• You may register using email and password, or by signing in with Google ("Continue with Google"). You may also link a Google account to an existing account in DJ Admin → Settings → Account & Security
• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials (and, if you use Google sign-in, for the security of your Google account). We receive limited profile information from Google (e.g. email, name) only to provide the Service
• You must notify us immediately of any unauthorized use of your account

3.2 Account Types

• Free Accounts: Access to basic features with limitations
• Pro Accounts: Enhanced features and capabilities via paid monthly subscription

3.3 Account Responsibilities

• You are responsible for all activities that occur under your account
• You must not share your account credentials with third parties
• You must use the Service only for lawful purposes

4. Subscription and Billing

4.1 Paid Subscriptions

• Paid subscriptions provide access to premium features as described on our pricing page
• Subscriptions are billed monthly in advance
• All fees are non-refundable except as required by applicable law

4.2 Billing and Payment

• We use Stripe as our payment processor
• You authorize us to charge your payment method for all applicable fees
• You must provide current, complete, and accurate billing information
• We may suspend or terminate your account for failed payments

4.3 Changes to Pricing

• We reserve the right to modify our pricing at any time
• Price changes will be communicated at least 30 days in advance
• Continued use after price changes constitutes acceptance of new pricing

4.4 Cancellation

• You may cancel your subscription at any time through your account settings or Stripe Customer Portal
• Cancellations take effect at the end of your current billing period
• You retain access to paid features until the end of your billing period

5. Acceptable Use

5.1 Permitted Uses

• Creating and managing music events
• Submitting appropriate song requests
• Using analytics and reporting features
• Interacting with the platform in good faith

5.2 Prohibited Uses

You agree not to:

• Use the Service for any illegal, harmful, or unauthorized purpose
• Submit inappropriate, offensive, defamatory, or copyrighted content without permission
• Attempt to gain unauthorized access to other users' accounts, data, or any part of our systems
• Use automated systems, bots, or scripts to access the Service without express written permission
• Interfere with, disrupt, or overload the Service, servers, or networks
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use the Service to spam, harass, threaten, or harm other users
• Submit malicious code, viruses, malware, or any harmful software
• Violate any applicable local, state, national, or international law or regulation
• Collect or harvest personal information about other users without consent
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service for any commercial purpose not expressly permitted
• Attempt to circumvent any security measures or access controls
• Use the Service in any way that could damage our reputation or business
• Engage in any activity that violates the rights of others
• Use the Service to distribute unsolicited promotional content
• Create multiple accounts to evade restrictions or limitations

6. Content and Intellectual Property

6.1 Your Content

• You retain ownership of content you submit to the Service
• You grant us a license to use, store, and display your content as necessary to provide the Service
• You represent that you have all necessary rights to the content you submit
• You are responsible for ensuring your content complies with applicable laws

6.2 Our Intellectual Property

• The Service and its original content, features, and functionality are owned by us
• The Service is protected by copyright, trademark, and other intellectual property laws
• You may not use our trademarks or copyrighted materials without permission

6.3 Music and Copyright

• You are responsible for ensuring you have rights to request or play any music through the Service
• We do not provide music licensing and are not responsible for copyright infringement
• You must comply with all applicable music licensing requirements

7. Privacy and Data Protection

7.1 Data Collection and Use

• Our collection and use of personal information is governed by our Privacy Policy
• We implement appropriate security measures to protect your data
• We may use aggregated, anonymized data for analytics and service improvement

8. Service Availability and Modifications

8.1 Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted or error-free service
• Scheduled maintenance will be communicated in advance when possible
• We are not liable for temporary unavailability due to technical issues, third-party failures, or circumstances beyond our control

8.2 Service Modifications

• We may modify, suspend, or discontinue any part of the Service at any time with or without notice

• Continued use after modifications constitutes acceptance of changes

• We may investigate suspected violations and take appropriate action, including account suspension or termination
• We may cooperate with law enforcement when required by law or when we believe it's necessary to protect our rights or the rights of others

9. User-Generated Content and Community Guidelines

9.1 Content Standards

• All song requests and user-generated content must be appropriate for public events
• Content must not violate any laws or third-party rights
• We reserve the right to remove inappropriate content at our discretion

9.2 Community Guidelines

• Treat all users with respect and courtesy
• Do not engage in harassment, bullying, or discriminatory behavior
• Report inappropriate behavior or content to our support team

10. Third-Party Services

10.1 Integration Services

• The Service integrates with third-party services including Stripe for payments and Google for optional sign-in and account linking ("Continue with Google" and linked accounts in Settings)
• Your use of third-party services (including Google sign-in) is subject to their respective terms and conditions and privacy policies
• We are not responsible for the availability or functionality of third-party services

10.2 Third-Party Content

• The Service may contain links to third-party websites or content
• We do not endorse or take responsibility for third-party content
• Your interactions with third parties are solely between you and them

11. Limitation of Liability

11.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY.

11.3 Maximum Liability

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold us harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including reasonable attorney's fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms or any applicable law or regulation
• Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
• Any content you submit, post, or transmit through the Service
• Any disputes between you and other users
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any viruses, worms, bugs, trojan horses, or similar harmful code that may be transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

This indemnification obligation will survive termination of these Terms and your use of the Service.

13. Termination

13.1 Termination by You

• You may terminate your account at any time through your account settings
• Termination does not relieve you of any obligations incurred prior to termination

13.2 Termination by Us

We may terminate, suspend, or restrict your account immediately, with or without notice, if you:

• Violate these Terms or any applicable law
• Fail to pay applicable fees
• Engage in fraudulent, illegal, or harmful activities
• Abuse, misuse, or attempt to exploit the Service
• Pose a security risk to the Service or other users
• Engage in conduct that we determine, in our sole discretion, to be harmful to us, other users, or third parties
• Create liability for us or interfere with our ability to provide the Service

We may also terminate accounts that have been inactive for an extended period.

13.3 Effect of Termination

• Upon termination, your right to use the Service ceases immediately
• We may delete your account and data, subject to legal retention requirements
• Provisions that should survive termination will remain in effect

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

14.2 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration rather than in court, except for claims that may be brought in small claims court.

You agree that disputes must be brought in an individual capacity and not as part of a class action or collective proceeding.

15. General Provisions

These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

15.5 Updates to Terms

We may update these Terms from time to time. We will notify users of significant changes through the Service or by email. Continued use after changes constitutes acceptance of the updated Terms.
